MYCAREHEALTH INC and CareFemPowered technologies., a American corporation («MYCARE HEALTH INC.», « our », « us », or « we ») offers an end-to-end platform for parents, businesses, patients, healthcare providers, and families as-a-service product (« CAREfemPOWERED » or the « CAREfemPOWERED platform») which also includes multiple mobile applications (“Mobile App”) and associated web-based version of the healthcare provider, patient, family, and administrator interfaces in CAREfemPOWERED and MYCARE HEALTH INC. (termed collectively as the “interfaces”).

You may use CAREfemPOWERED as a patient user (“Patient”), healthcare administrator (“Admin”), Patient’s designated healthcare professional (“Provider”), friend or family (“Loved-ones”, “Family”), or caregiver (“Caregiver”).

CAREfemPOWERED, among other things, has been designed to enable and empower you to manage your health or Patient’s health information across national and international healthcare providers or sponsors and their specified personnel (each, a “Sponsor”).

CAREfemPOWERED and its technology platform respects your privacy. In this respect, we have created this specified Privacy Policy to inform you what information/data we collect when you use our platforms and services and any potential disclosures of information/data.

Consent to CAREfemPOWERED Privacy Policy.

The user is termed as “you” in this Privacy Policy and refers to a Parent, Employee/Employer, Patient, Provider, Family, Admin, Loved-Ones and/or Caregiver end user of CAREfemPOWERED. By using CAREfemPOWERED services and platform, you agree to this Privacy Policy. This is our Privacy Policy currently and can be updated with any new versions for rules and regulations. If we do change this Privacy Policy, we will post any new version through the CAREfemPOWERED website, and it is your responsibility to review this Privacy Policy periodically. When and if we do change this Privacy Policy, you will be notified to revise the “latest version” with the specified updated date via your mobile app or our website interface. Your continued use of CAREfemPOWERED constitutes your agreement to this Privacy Policy and any updates it contains.

Information that CAREfemPOWERED collects.

(a) Personal Information.

In this Privacy Policy, “Personal Information” means any information that may be used to identify an individual. When you use CAREfemPOWERED, whether as a Parent, Employee/Employer, Patient, Provider, Family, Admin, Loved-Ones and/or Caregiver, we may collect certain Personal information, such as your first and last name, age, gender, employment status, physical address, email, phone number, or any other relevant contact information, whether at work or at home.

If you are a Patient, you must acknowledge that we may collect this Personal Information from you directly or through your Caregiver, Provider, or Family/” Loved-ones” (“Circle of Care”). We may, at any time, as you or your Caregiver, Provider, or Family to provide Personal information about you as this can enable us to enhance your optimal use of CAREfemPOWERED services. Please note, it is your choice whether or not to provide that Personal Information through CAREfemPOWERED; provided that if, as a Patient, you designate a Caregiver, Provider, Admin, or Family/Loved Ones, the Caregiver, Provider, Admin, or Family/Loved ones, may elect to provide your Personal Information on your behalf. If the latter is the case, the Caregiver, Provider, Admin, or Family/Loved ones, is solely responsible for obtaining your consent to provide such Personal Information. If you decide to choose not to provide the requested Personal Information, you may not be able to use certain features of the CAREfemPOWERED Platform and Services.

(b) Health Information.

You acknowledge and agree that if you are a Patient, we may collect your Health information. “Health Information” in this Privacy Policy means that any information related to your physical or mental health, including your medical history, family history, health background and current health status information (i.e. information about your age, sexual behaviour, sexual orientation, demographics (ethnicity, marital status, salary, and education information) any information related to the diagnosis and treatment of health conditions, over-the-counter medicines, current prescription medications, laboratory test results, and health insurance information.

(c) Technical Information

We may collect, use, and interpret technical data and any related information including, but not limited to, technical information about your device, system application software, peripherals and your interaction with CAREfemPOWERED platforms (“Technical Information”). Technical Information will be gathered on a periodical basis which facilitates and enables us to overview the software for updates, product support and enhancements as well as any other services we provide to you in relation to CAREfemPOWERED and the Mobile Apps. We may also receive and automatically collect information on our server logs from your mobile device, this could include your IP address, cookie information, browser information and the page you request. This is not, by any means, deemed by CAREfemPOWERED to constitute Personal Information. CAREfemPOWERED will not use it in any way that associates any such information with you identify or personal information. CAREfemPOWERED only may aggregate Technical Information and used anonymously, whereby, CAREfemPOWERED owns this information and may use it in any manner we deem as appropriate.

(d) Location Based Information.

You acknowledge and agree that we may collect location-based data from you (“Remote Monitoring”/” Location-Based-Information”). When you use the Mobile App or our Remote Monitoring Services, we may collect Location-Based-Information from your device. You acknowledge that CAREfemPOWERED can track your location though, it is only to administer the functionality of the Mobile App and desktop interfaces for our services to send you location-based communications and telemedicine, transportation, or nutritional services you request (i.e. advertisements for goods and services).

(e) How CAREfemPOWERED (MYCARE HEALTH Inc) uses Information.

Except as described herein this Privacy Policy and in our Terms of Services, Personal Information, Health Information, Technical Information, and Location-Based-Information (collectively termed herein as “Information”) that Parents, Employees/Employers, Patients, Providers, Family/Loved-Ones, Admin or Caregivers, will be kept confidential and used to support the use of CAREfemPOWERED platform by Parents, Employees/Employers, Patients, Providers, Family/Loved-Ones, Admin or Caregivers and Enabled Sponsors (defined below) and any applications that interact with it. Except as required by law in your country/region we provide our services, as between CAREfemPOWERED, the Parents, Employees/Employers, Patients, Providers, Family/Loved-Ones, Admin or Caregivers owns all right, title and interest in and to any information with the exception of Technical Information that we collect from the Parents, Employees/Employers, Patients, Providers, Family/Loved-Ones, Admin or Caregivers through their use of and interaction with CAREfemPOWERED.

CAREfemPOWERED (MYCARE HEALTH inc) was created to allow Parents, Employees/Employers, Patients, Providers, Family/Loved-Ones, Admin, Sponsors or Caregivers to manage and track their communication and relationship with one another. To provide for this service/exchange, CAREfemPOWERED ensures that each user that provides and/or contributes any information permits the users that we envision. For this explicit reason, we need a license from you to use Parents, Employees/Employers, Patients, Providers, Family/Loved-Ones, Admin, and Caregiver Information, whether it be directly collected from you, or your Provider, Family/Loved-Ones, Admin or Caregiver.

Hereby, you grant CAREfemPOWERED a non-exclusive, sub-licensable, transferable, royalty free license to use Information in order to provide CAREfemPOWERED to Parents, Employees/Employers, Patients, Providers, Family/Loved-Ones, Admin or Caregiver and Enabled Sponsors to monitor and improve CAREfemPOWERED’s platforms and services. The license is non-exclusive, which means that you are free to license the information to anyone else in addition to us, fully-paid and royalty-free meaning that we are not required to pay you for our use of the Information, sub-licensable meaning that we are able to use affiliates and subcontractors to provide CAREfemPOWERED services, transferable meaning that we may transfer it to a third party should we restructure our business, irrevocable, meaning that you may not revoke or rescind such license for any reason once the Information is uploaded and world-wide because the Internet is and the Service is available in France, USA, and Canada and can extend more globally in reach. Any Information that we receive from a Sponsor will be handled in accordance with our agreement with such Sponsor. You may have additional rights under law depending on your location to any additional Information about you that we receive from a Sponsor.

You grant CAREfemPOWERED a perpetual, non-exclusive, sub-licensable, transferable, royalty free license to use such Information and any other data that we may collect from you through Parents, Employees/Employers, Patients, Providers, Family/Loved-Ones, Admin or Caregiver use of and interaction with CAREfemPOWERED in order to collect, develop, create, extract, or generate statistics (“Big Data”) and other information to compile, synthesize, and analyse (“Blind Data”), which will be owned solely by CAREfemPOWERED and MYCAREHEALTH INC. and may be used for any lawful business purpose without a duty of accounting to you, provided that such data is not personally identifiable and does not identify the source of such data.

(f) Sharing Information.

With the exception as set forth herein and as necessary to enable any third-party applications that you should authorize, CAREfemPOWERED does not rent, sell or share Information with or to third parties, and Information is only used to provide you with CAREfemPOWERED products, services, and complies with any requirements of the laws in France, USA, and Canada.

Any Agents, vendors of technology and/or contractors of CAREfemPOWERED may have access to your Information on a “Need-to-Know” basis solely for the purposes of performing services on behalf of CAREfemPOWERED and providing essential elements that enables better services of CAREfemPOWERED to you. All such agents, contractors, or any third-parties who have access to such information are required to keep the Information confidential and cannot use it for any other purposes that to carry out the services they are performing for CAREfemPOWERED or as otherwise required by law. Notwithstanding from the above statements, CAREfemPOWERED may share or disclose your Health Information to agents, contractors, or other third-parties only as allowed or required under applicable law(s).

If, as a Patient, you validate another end user as your designated Caregiver, Provider, or Family/Loved Ones, we retain the right to share certain Information with that specific/specified Caregiver, Provider, Admin, or Family/Loved One user. In addition, CAREfemPOWERED may Share your Information with Sponsors with whom you have a relationship for the provision of healthcare products and services and that you have validated and connected with through a Sponsor access code or link distributed through the Mobile Apps or Dashboard interface (termed herein, “Enabled Sponsor”). We can share this Information, which can include Personal Information and Health Information with Enabled Sponsors to provide essential elements to CAREfemPOWERED platform to enable communication between Enabled Sponsors and you. We do not share any Information, other than Big Data and Technical Information with Sponsors. In addition, CAREfemPOWERED or its agents or contractors may disclose information if required to do so by law or in good faith belief that such action is necessary for the following:

(1) Conform to the law or comply with legal processes

(2) Protect and defend the rights or property of CAREfemPOWERED or its agents and contractors.

(3) Act in urgent circumstances to protect the personal safety of CAREfemPOWERED, Mobile App, or the general public.

Lastly, If CAREfemPOWERED should ever merge with another organization, file for bankruptcy, or sell our assets or capital stock, we may transfer this Information to a third party or share the Information to the company, agents, or its contractors with which we enter into such transaction as a part of such transaction.

(g) Information Security.

We maintain physical, electronic, and procedural safeguards designed to protect the Information which includes, without limitation, encrypting all Personal Information end-to-end using AES and TLS encryption

Despite the actions and precautions, we take, no data transmission over the Internet can be 100% guaranteed to be secure. By consequence, we cannot ensure or warrant the 100% security of your Information and you acknowledge and agree that you transmit it to us at your own risk.

Keep in mind that whenever you voluntarily disclose Information on our message boards, interfaces, or any public forums (i.e. emails, community messaging, or voluntarily use features of CAREfemPOWERED that inherently Shares or that allow sharing of Information such as features that allow Parents, Employees/Employers, Patients, Providers, Family/Loved-Ones, Admin, and/or Caregiver to share Information with another Parents, Employees/Employers, Patients, Providers, Family/Loved-Ones, Admin, and Caregiver or that allow the latter to share Patient’s Information with an enabled Sponsor, that Information can be collected and used by others.

By posting Information online that is publicly accessible, you may receive unsolicited ads or messages from other parties that make aware of your location. We are not responsible for the security or privacy of any Information you choose to submit in connection with public features.

(h) Third Party Apps, Services, and Technology.

We may provide links to third-party websites within CAREfemPOWERED or in other communications to you. These links may appear as a specific domain name or URL and can be activated by clicking on an icon or graphic. Be aware that other websites and services, including the websites of third parties that you connect with through CAREfemPOWERED, may collect personally Identifiable Information about you. This Privacy Policy does not cover the information practices of those third-party websites, services, or applications and cannot control nor cannot be responsible for the information collection practices of any such websites, services, or applications. In this case, we encourage you to carefully review the terms of use, privacy policies, and any other legal notifications on such third-party websites before using or providing information.

CAREfemPOWERED may employ third party technologies that require you to accept such third party’s terms. This Privacy Policy does not cover the information practices of those third-party technologies.

(i) International Information Transfers

Information collected from you is stored and processed in our base in the USA but can be collected in our other office locations in Canada, France or any other country CAREfemPOWERED or its affiliates, subsidiaries, agents, or contractors, maintain facilities. If you are accessing CAREfemPOWERED from the EU or the United States, please note different regions have different laws governing data collection and use. In this case, you are agreeing to the transfer of your data to the United States, Canada, and France and processing globally. By providing your Information you consent to any transfer and processing in accordance with this Privacy Policy.

(j) HIPAA

This specific Privacy Policy and the privacy security practices as described in this Privacy Policy are designed to comply with the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”, as such defined in this Privacy Policy as HIPAA) have their own privacy and security obligations with respect to your Personal Information and Health Information. In addition, we have agreements in place with Sponsors, which define certain of our security and privacy obligations. In this case, we highly encourage you to contact any and each Sponsor with whom you interact with through CAREfemPOWERED and our Mobile App regarding their privacy and security practices.
